These Terms and Conditions (“Terms”) govern your access to and use of the HeartSync mobile application, the website at https://heartsync.theeduassist.com/, and any related services (collectively, the “Service”). The Service is operated by The EduAssist (“we,” “us,” or “our”).
HeartSync is a secure video call platform designed exclusively for mental health facilities to facilitate telehealth consultations, appointment scheduling, and secure communication between patients and licensed mental health providers.
Important Notice: HeartSync is not intended for medical emergencies. If you are experiencing a mental health crisis or emergency, including thoughts of suicide or harm to others, immediately call emergency services (e.g., 911 in the United States) or go to the nearest emergency room. The Service is not a substitute for in-person care in urgent situations.
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account Registration
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service independently. Minors may only use the Service under the supervision and with the consent of a parent, guardian, or authorized facility provider.
- To access certain features, you must register an account. You agree to provide accurate, current, and complete information and to keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- We reserve the right to suspend or terminate accounts for violations of these Terms or applicable laws.
2. Description of the Service
HeartSync enables:
- Secure video and audio consultations between patients and providers.
- Appointment scheduling and reminders.
- Secure sharing of treatment-related information (with consent).
The Service is a communication tool and does not provide medical diagnosis, treatment, or advice. All clinical decisions are the responsibility of your licensed mental health provider.
Disclaimer: HeartSync is not a medical device. It does not diagnose, treat, cure, mitigate, or prevent any disease or health condition. The Service is intended to facilitate communication for mental health care delivery by qualified professionals. Always consult your healthcare provider for medical advice. Do not disregard professional medical advice or delay seeking it because of something you experienced on the Service.
This disclaimer complies with Google Play requirements for health-related apps.
3. User Responsibilities
You agree to:
- Use the Service only for lawful purposes and in accordance with facility policies.
- Not record sessions without explicit consent from all participants and compliance with applicable laws.
- Maintain a private and distraction-free environment during sessions.
- Not share your account or allow unauthorized access.
- Report any technical issues or suspected security breaches immediately.
- Comply with all applicable laws, including those related to privacy and health information.
Prohibited activities include:
- Interfering with the Service’s operation.
- Transmitting harmful code or engaging in unauthorized data access.
- Using the Service for non-mental health purposes.
4. Privacy and HIPAA Compliance
Your privacy is critical, especially with sensitive mental health information. Our practices are described in our Privacy Policy (available at https://heartsync.theeduassist.com/privacy), which is incorporated by reference.
- We comply with the Health Insurance Portability and Accountability Act (HIPAA) where applicable.
- Protected Health Information (PHI) is handled only for treatment, payment, and health care operations.
- We maintain Business Associate Agreements (BAAs) with vendors handling PHI.
- Sessions are end-to-end encrypted, and recordings are only made with explicit consent.
5. Intellectual Property
- The Service, including its software, design, and content, is owned by us or our licensors and protected by copyright, trademark, and other laws.
- We grant you a limited, non-transferable license to use the Service for its intended purpose.
- You retain rights to your personal data but grant us a license to use it as necessary to provide the Service.
6. Limitations of Liability and Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW:
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or secure against all threats.
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
- Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

In emergencies, rely on traditional emergency services, not the Service.

These Terms are governed by the laws of the United States and the state where the operating facility is located (without regard to conflict of laws principles). Any disputes shall be resolved in the courts of that jurisdiction.
10. Compliance with Google Play and Other Regulations
- We comply with Google Play policies for health apps, including accurate Data Safety declarations and health feature disclosures.
- Permissions (e.g., camera, microphone) are requested only for core functionality (video calls).
- The Service supports data deletion requests as required.
